1. PARTIES
DOMAİN BİLİŞİM HİZMETLERİ (hereinafter referred to as "domain.com.tr" or the "Company"), operating at Şehitkubilay Mah. Aşağı Barak Sokak No:18/13 Ankara, Türkiye, and the real or legal person who purchases products or services, registers, or otherwise uses the website www.domain.com.tr (the "Site") (hereinafter referred to as the "CUSTOMER" or "User") hereby agree to the terms set out below.
By creating an account, placing an order, or otherwise beginning to use any service on the Site, the CUSTOMER declares that they have read, understood, and unconditionally accepted this entire agreement.
2. DEFINITIONS
domain.com.tr / Company: Domain Bilişim Hizmetleri
CUSTOMER: The real or legal person purchasing services or registering an account through the Site;
Service: Domain registration, renewal, and transfer, hosting (shared, VPS/VDS, etc.), email, and all other digital services offered by the Company;
Registrar / Registry Operator: Organizations authorized by ICANN or the relevant national registry authority (e.g., TRABİS/nic.tr for ".tr" domains) through which domain.com.tr carries out its operations;
Control Panel: The WHMCS client area and related hosting control panels (e.g., cPanel) through which the CUSTOMER manages their services;
Content: Any data, files, software, text, images, audio, or video uploaded by the CUSTOMER to the servers as part of hosting services.
3. SUBJECT, SCOPE AND EFFECTIVE DATE OF THE AGREEMENT
3.1 This Agreement sets out the general terms governing the sale and use of domain registration/renewal/transfer services, hosting services, and related services offered by domain.com.tr through the Site, as well as the rights and obligations of the parties in this regard.
3.2 The Agreement enters into force upon the CUSTOMER's electronic confirmation of an order and remains in effect for as long as the relevant service is active.
3.3 This Agreement, together with domain.com.tr's separately published Privacy Policy / Data Protection Notice, Distance Sales Agreement, Acceptable Use Policy (AUP), and Dispute Resolution Policy, forms a single, integrated set of terms. The provisions of those policies are an integral part of this Agreement. In the event of any conflict, the specific policy governing the relevant subject matter shall prevail.
3.4 domain.com.tr reserves the right to amend this Agreement from time to time in line with ICANN rules, national registry authority requirements, applicable law, or operational necessity. The current version of the Agreement is always published on the Site and takes effect as of its publication date. Continued use of the services after such changes constitutes acceptance of the updated terms.
4. NATURE OF THE SERVICE AND GENERAL OBLIGATIONS
4.1 The CUSTOMER represents and warrants that all information provided when purchasing services is accurate, current, and complete. The CUSTOMER is obligated to update any change in such information within a reasonable time via the Control Panel.
4.2 In the event of suspicious or inconsistent information, domain.com.tr may request identity/address verification documents from the CUSTOMER. Failure to provide the requested information/documents within a reasonable period may result in suspension or cancellation of the relevant service.
4.3 The CUSTOMER is solely responsible for the confidentiality and security of their username, password, and other access credentials. All actions performed through the account are deemed to have been carried out by the CUSTOMER.
4.4 domain.com.tr reserves the right to restrict access to, suspend, or cancel any account/service, temporarily or permanently, in the event of a breach of this Agreement by the CUSTOMER.
5. PROVISIONS RELATING TO HOSTING SERVICES
5.1 The CUSTOMER is solely responsible for any and all content stored in the disk space and databases allocated to them. Hosting of any text, audio, video, software, or other material that infringes Turkish law or international intellectual/artistic property, patent, or trademark rights — including material distributed without the rights holder's consent — is prohibited. domain.com.tr reserves the right to suspend or terminate the relevant service upon detecting such content.
5.2 If applications run within the CUSTOMER's allocated resources adversely affect the services of other users sharing the same physical or virtual environment (e.g., through resource abuse or actions that sabotage the server), domain.com.tr reserves the right to suspend or terminate the relevant service in order to protect the quality of service for other users.
5.3 If the Disk Space, Database Space, or Data Traffic (bandwidth) quotas specified in a hosting package are exceeded, overage fees are automatically billed on that month's invoice, and the CUSTOMER is notified by email and/or SMS. The payment due date for overage fees is 5 business days following invoice generation; failure to pay within this period may result in suspension of the relevant service.
5.4 Packages marketed as offering "unlimited" disk space/traffic may not be used as a personal or corporate backup center, file server, or file-transfer/sharing hub outside of the CUSTOMER's website/application. Upon detecting such use, domain.com.tr may provide prior notice and a reasonable period to remedy the situation, or may terminate the service directly.
5.5 domain.com.tr qualifies as a "hosting provider" under Turkish Law No. 5651 and is under no obligation to proactively monitor hosted content or investigate potential unlawfulness. However, the following may be suspended without prior notice to the CUSTOMER:
Gambling, betting, pornography, or child exploitation material;
Hacking, phishing, or malware distribution;
Content targeting public order or sacred/moral values, or causing public sensitivity;
Content whose unlawfulness has been determined or reported by competent authorities;
Sites found to contain serious security vulnerabilities.
Upon proper notification from an aggrieved third party, or at the request of competent authorities, the relevant content/site may be taken down in whole or in part without prior notice to the CUSTOMER.
5.6 domain.com.tr's email servers may not be used to send unsolicited, disruptive, or advertising-related bulk email to third parties. Upon detection of such use, the relevant service may be suspended or terminated. Customers with legitimate high-volume email needs are advised to purchase a VPS/VDS (virtual server) service.
5.7 Backups and Liability for Data Loss: domain.com.tr performs periodic backups of its general infrastructure for systemic continuity purposes; however, these backups do not guarantee individual restoration of CUSTOMER content and may only be used by domain.com.tr for reconstruction purposes in the event of a major system failure. As the value and importance of data can only be assessed by the CUSTOMER, the CUSTOMER is responsible for regularly backing up their own critical data via the Control Panel and storing it in their own environment. In the event of data loss, a support ticket must be submitted within 12 hours of the incident; remediation may not be possible for notifications made after this period. domain.com.tr's liability for data loss is limited to the terms set out in this clause.
5.8 domain.com.tr endeavors to provide reasonable advance notice of planned maintenance; however, brief interruptions may occur without prior notice in the case of urgent security or infrastructure interventions.
6. DOMAIN REGISTRATION, RENEWAL AND TRANSFER
6.1 The CUSTOMER and domain.com.tr agree that all authority over an allocated domain name rests with the CUSTOMER. Where a domain service is purchased on behalf of a legal entity, the entity's authorized signatory is deemed the domain's authorized representative.
6.2 The CUSTOMER accepts all rules and policies established by domain.com.tr, the Registrar, ICANN, or the relevant national registry authority (e.g., TRABİS for ".tr" domains), as they may be amended from time to time.
6.3 A domain is not considered fully delivered until registration is completed and active in the relevant registry system. For domains that cannot be registered for technical reasons, or that require documentation, are reserved, or are premium domains, domain.com.tr will unconditionally refund the CUSTOMER and may cancel the order.
6.4 Payment: Service fees are paid by the CUSTOMER via the payment methods offered by domain.com.tr (online payment by credit card, PayPal, bank transfer/EFT, etc.). Fees may be listed in Turkish Lira or US Dollars; however, collection is made in Turkish Lira based on the exchange rate applicable at the time of order. If payment cannot be collected, or is later reversed through a dispute/chargeback, domain.com.tr may pursue legal remedies for collection and may suspend or permanently terminate the relevant services. If a party other than the CUSTOMER claims to be the rightful owner of a service, only the service (domain) itself — not any content uploaded by the CUSTOMER — will be transferred to the paying party.
6.5 Domains are registered for a term of 1–10 years, at the CUSTOMER's discretion. Renewal is completed by the CUSTOMER placing an order and making payment via the Control Panel. domain.com.tr is under no obligation to track or initiate domain renewals on the CUSTOMER's behalf; reminder notifications are sent to the email address provided at registration, but domain.com.tr bears no liability if such notifications are not received or noticed. Monitoring the domain's expiration date is ultimately the CUSTOMER's responsibility.
6.6 If the renewal fee cannot be collected for any reason, the domain will become inactive upon expiration. An inactive domain may be renewed and reactivated upon the CUSTOMER's request within 30 days. After 30 days, the domain enters the Redemption Period, during which any additional costs charged by ICANN/the registry for recovery will be passed on to the CUSTOMER. Upon expiration of the Redemption Period, the domain enters the cancellation (Pending Delete) process, during which no renewal is possible; upon completion of this process, the domain becomes available for registration by the public.
6.7 Under ICANN rules, a domain may not be transferred to another registrar within 60 days of its registration or transfer date.
6.8 This Agreement remains valid for as long as the CUSTOMER continues to use domain.com.tr's registration services. Amendments made by domain.com.tr in accordance with applicable law or international domain rules are binding on the CUSTOMER. Should the CUSTOMER unilaterally terminate this Agreement, no refund will be issued except as expressly provided under Section 8 (Cancellation and Refund Policy).
6.9 WHOIS/Registration Data: The CUSTOMER acknowledges that, in accordance with international domain policies, the following information provided at registration may be publicly viewable via WHOIS services: full name/company name, email address, postal address, nameserver information, and registration/expiration dates. domain.com.tr bears no liability for third-party access to or commercial use of such publicly available information. Where permitted by applicable rules, the CUSTOMER may make use of WHOIS privacy/proxy services if offered as a separate product.
6.10 The CUSTOMER is deemed to accept domain.com.tr's Dispute Resolution Policy (e.g., UDRP-equivalent procedures); it is the CUSTOMER's responsibility to monitor any changes to this policy. No refund will be issued if a domain registration is cancelled as a result of a policy change.
6.11 The CUSTOMER may transfer a domain they own to a third party via the Site or an authorized representative. Once a transfer is completed, the domain cannot be reclaimed and its operation cannot be interfered with; it is the CUSTOMER's responsibility to assess all risks prior to transfer. domain.com.tr bears no liability for disputes arising after a transfer. Transfer of a domain to another registrar is only possible using a valid transfer authorization code (EPP/Auth code); once such a transfer is completed, domain.com.tr has no further responsibility with respect to that domain.
6.12 A domain that has been sold and successfully registered in the relevant registry cannot be cancelled, its name cannot be changed, and no refund will be issued after the sale, except for the exceptions set out in Section 6.3.
6.13 Prohibited Uses: The CUSTOMER agrees and undertakes not to use, or permit third parties to use, domain services purchased for the following purposes:
High-volume or repetitive automated queries directed at domain.com.tr's services (e.g., bulk WHOIS lookups);
Mail bombing, packet flooding, or similar attack techniques;
Unauthorized access to servers or exploitation of security vulnerabilities to cause harm;
Defamation, threats, harassment, or other unlawful conduct directed at any person or entity;
Offenses defined under Turkish Law No. 5651;
Terrorism, hate crimes, child exploitation material, or links to such content;
Attempts to impersonate another person or entity (phishing/impersonation);
Content or domain names contrary to public morality (e.g., sexual content, unlawful gambling).
In the event of a breach of these provisions, domain.com.tr may take unilateral action with respect to the relevant domain without prior notice. The CUSTOMER remains responsible for any unlawful use resulting from sharing the domain with third parties. domain.com.tr is obligated to cooperate with competent authorities in legal proceedings but is not obligated to identify the perpetrator of any misconduct.
7. SPECIAL PROVISIONS FOR ".TR" DOMAINS
7.1 The registration, renewal, and transfer of ".tr" domain names are subject to TRABİS (the ".tr" Network Information System), operated under Turkey's Information and Communication Technologies Authority (BTK), and related legislation. domain.com.tr provides brokerage services in this context in its capacity as a Registrar.
7.2 Certain ".tr" sub-domains (e.g., gov.tr, k12.tr, av.tr, edu.tr) are subject to additional documentation/eligibility requirements determined by TRABİS. The CUSTOMER is responsible for meeting these requirements; applications that fail to meet them may be rejected, with any payment refunded.
7.3 Changes made to the TRABİS system or new regulations published by BTK automatically apply to this Agreement; domain.com.tr will inform the CUSTOMER of such changes via the Site or by email.
8. CANCELLATION, RIGHT OF WITHDRAWAL AND REFUND POLICY
8.1 Under Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, the right of withdrawal generally cannot be exercised for services performed electronically and instantaneously, or services whose performance begins immediately at the consumer's request (which includes domain registration), since performance begins upon the CUSTOMER's confirmation. The CUSTOMER separately acknowledges this at the time of order confirmation.
8.2 For hosting services, where explicitly stated on the relevant product page, a refund may be requested within a specified period following the initial purchase (e.g., 14 days), provided the service has not been actively used. As the period and conditions may vary by product, the current refund terms set out on the relevant product page and in the Distance Sales Agreement shall prevail.
8.3 Domain registration/renewal/transfer fees are non-refundable, except as set out in Sections 6.3 and 6.12, as a substantial portion of these fees is paid to third-party registry/registrar organizations.
8.4 Service cancellation is carried out by the CUSTOMER submitting a request via the Control Panel or providing written notice through the support channels.
9. AFTER-SALES SUPPORT
9.1 domain.com.tr's after-sales support commitment to CUSTOMERs is limited to the conditions defined in this Section.
9.2 The CUSTOMER may use the support page on the Site, email, telephone, or live chat to resolve issues related to their services.
9.3 domain.com.tr aims to respond to CUSTOMER requests as promptly as possible; however, delays may occur due to technical or operational reasons, and domain.com.tr bears no liability for such delays.
9.4 Support is limited to issues relating to the normal operation of a service; the CUSTOMER's special requests or custom configurations, as well as issues arising from third-party software/plugins, may fall outside the scope of support and may be subject to a separate fee.
9.5 The CUSTOMER must provide accurate and complete information when submitting support requests; domain.com.tr bears no liability for issues arising from incorrect or incomplete information.
9.6 Support is limited to the package purchased by the CUSTOMER; additional requests may be fulfilled for a fee. Support channels may not be used for spam, harassment, or other abuse.
9.7 "Emergency support" is defined as being limited to serious system failures and service outages. domain.com.tr may temporarily restrict system access during support interventions where deemed necessary.
9.8 domain.com.tr's sole point of contact for support purposes is the account holder (webmaster/authorized representative); support will not be provided to third parties who are not the account holder, except for duly authorized representatives.
10. PROTECTION OF PERSONAL DATA
10.1 domain.com.tr processes the CUSTOMER's personal data in accordance with Turkish Law No. 6698 on the Protection of Personal Data ("KVKK") and applicable legislation (as well as, where relevant, other applicable data protection laws such as the GDPR). The purposes and legal grounds for processing personal data, potential recipients, and the CUSTOMER's rights are set out in a separate Privacy Policy / Data Protection Notice published on the Site.
10.2 domain.com.tr does not share, sell, or rent CUSTOMER data to third parties, except where required by law, at the request of a competent authority, or as part of a legal proceeding.
10.3 The CUSTOMER is responsible for the accuracy of their account and contact information; providing false or incomplete information constitutes a breach of this Agreement.
10.4 The CUSTOMER may not share their password or other security credentials with third parties; domain.com.tr bears no liability for damages arising from a breach of account security.
10.5 domain.com.tr protects user data using reasonable technical and administrative measures; however, its liability for data loss resulting from system failures, maintenance activities, or unforeseeable cyber incidents is limited to the terms set out in Section 5.7.
10.6 The CUSTOMER may exercise their rights under KVKK Article 11 (including the right to request information, correction, deletion, or to object to processing) by submitting a written request to domain.com.tr.
11. INTELLECTUAL PROPERTY RIGHTS
11.1 All intellectual property rights relating to the Site's design, software, logo, trademarks, and content belong to domain.com.tr; purchasing a service does not constitute a transfer of any rights in these elements to the CUSTOMER.
11.2 The CUSTOMER represents and warrants that they are the lawful owner of, or hold the necessary rights to use, any content (text, images, software, etc.) uploaded as part of a hosting service. The CUSTOMER bears full legal and criminal liability for any content that infringes the intellectual property rights of third parties.
12. FORCE MAJEURE
12.1 Natural disasters, fire, war, acts of terrorism, epidemics/pandemics, cyberattacks, power or infrastructure outages, decisions of public authorities, outages originating from third-party data centers/registries/registrars, and other events beyond the reasonable control of the parties that could not have been foreseen shall be deemed force majeure.
12.2 Neither party shall be liable for any delay or failure to perform arising from force majeure. If a force majeure event continues for more than 30 days, either party may terminate this Agreement.
13. LIMITATION OF LIABILITY
13.1 domain.com.tr's total liability arising from this Agreement shall, in all cases, be limited to the amount paid by the CUSTOMER for the relevant service over the preceding 12 months.
13.2 domain.com.tr shall not be liable for indirect damages, loss of profit, loss of data (subject to the terms of Section 5.7), loss of business, or loss of reputation.
13.3 Services are provided on an "as-is" basis; domain.com.tr makes no express or implied warranty of uninterrupted or error-free service, but undertakes to make reasonable commercial efforts to maintain service continuity.
14. NOTICES AND COMMUNICATION
14.1 All notices from domain.com.tr shall be sent to the email address on file for the CUSTOMER's account and shall be deemed delivered as of the date of sending. domain.com.tr bears no liability if notices fail to reach the CUSTOMER due to outdated contact information.
14.2 Notices from the CUSTOMER to domain.com.tr shall be made through the support/contact channels available on the Site.
15. SEVERABILITY AND ASSIGNMENT
15.1 If any provision of this Agreement is found invalid or unenforceable by a competent authority, the remaining provisions of the Agreement shall remain in full force and effect.
15.2 The CUSTOMER may not assign their rights and obligations under this Agreement to a third party without domain.com.tr's prior written consent. domain.com.tr may assign this Agreement, in whole or in part, to a successor entity.
16. DISPUTE RESOLUTION AND GOVERNING JURISDICTION
16.1 This Agreement shall be governed by the laws of the Republic of Türkiye.
16.2 Where the CUSTOMER qualifies as a consumer, disputes shall be resolved before the Consumer Arbitration Committees and Consumer Courts of the CUSTOMER's or domain.com.tr's place of residence, or, for disputes exceeding the applicable monetary threshold, before the competent courts.
16.3 For disputes of a commercial nature, the courts and enforcement offices of Ankara, Türkiye shall have jurisdiction.
16.4 domain.com.tr is not a judicial authority and plays only a supporting technical/administrative role, limited to information sharing, in disputes between parties; final decisions rest with the competent judicial authorities.
17. EFFECTIVE DATE
This Agreement takes effect upon the CUSTOMER's electronic confirmation via the Site and remains in force for the duration of the relevant service, until validly terminated by either party.
